Early detection of debt

Bringing together signals of debt from municipalities and fixed-income partners. These include energy and water companies, health insurers and landlords. Based on preselected criteria, determine how to approach these residents. These may include criteria such as size of debt, multiple signals and already known data.

Responsible use

Goal and impact

The aim is to identify debt among residents at an early stage and actively approach them for support. In this way, we want to avoid problems becoming (too) big.

Considerations

On 1 January 2021, the Municipal Debt Assistance Act (Wgs) was amended. Early detection of debt based on third-party signals has become a statutory duty for municipalities. A Data Protection Impact Assessment (DPIA) has been carried out - a privacy test that helps to identify and mitigate risks when processing personal data. The DPIA shows that the interests of the data subject must be in equal proportion to the interests of the person responsible for processing data. No more information should be requested and processed than is strictly necessary for the processing.

Human intervention

Based on signals, an advice for a follow-up action follows. A staff member reviews the advice and checks the data. The staff member then sets out the follow-up action. This could be a home visit or telephone contact or a letter.

Risk management

The DPIA lists the measures to avoid risks. The DPIA shows no residual risks, i.e. no risks remain for which no measures have been taken.

Legal basis

The Municipal Debt Relief Act, amended since 1 January 2021, allows designated creditors to report payment arrears. By sharing this data, signals of debt problems reach the municipality earlier. In this way, we can actively offer help to prevent increases in debt.

Operations

Data

The following data comes from the fixed charge partners: name, address, email, date of birth, phone number, reporter contact details, reported arrears and BSN.

These data are then cross-checked against the Basic Registration of Personal Data (BRP) and Allegro (Debt Assistance application) for accuracy and other ongoing processes for arrears.

  • Some residents receive income support, such as welfare benefits. You are then only allowed to have a maximum amount of money or equity. It is the municipality's job to check this. Therefore, the municipality gets information about the assets of this group. The municipality uses filtering to decide who to investigate further.

  • Stichting Inlichtingenbureau (IB)* receives lists of people on welfare benefits from municipalities and compares them with data from sources e.g. UWV, DUO and the Tax and Customs Administration. If there is any overlap (concurrence) that could affect the benefit, the IB sends a message about this to the municipalities. The municipality can then carry out further checks.

  • Assets can affect the right and amount of a benefit. Stichting Inlichtingenbureau (IB)* determines whether a person on social assistance benefit has assets above the set limit (tax-free assets). If so, the IB issues a signal about this to the municipality.
