INA personal and family law

With a calculation, we determine how much money a person has to pay for the maintenance of his or her ex-partner and/or their minor children. This amount must be paid to the Service.

Goal and impact

If you are divorcing your partner, you may need to make arrangements for alimony. Alimony is money for living expenses, such as groceries or rent. This allows your ex-partner to build their own life. Alimony may also be for the care of your children.

Are you receiving assistance from the Service? Then your ex-partner may have to give you money for your living expenses. This may be through agreements or a court decision. The Service then wants to know how much money you get for yourself or for your children.

The amount of your social assistance benefit depends on all your income, including alimony. The amount of alimony is calculated using a system called 'INA'. This algorithm looks at your income, the number of children, their ages and, for example, how much rent or mortgage you pay.

Does something change in your situation? If so, you must inform the Service yourself. The Service will then recalculate how much assistance you will receive.

Considerations

The calculation is always up to date as it is automatically updated when changes occur. The INA system is used not only by municipalities, but also by judges and lawyers.

Human intervention

The data entered in the INA programme is checked by quality staff. This is how we make sure everything is correct.

Risk management

The risks are mainly in filling in the data and in how the results of the calculation tool are used. Often, the data from the time of separation are no longer available. Therefore, calculations are usually made using the situation of today.

  • If a person receives a second reminder for a traffic fine and does not pay it (in full), he or she can be called by the CJIB. • A person in debt may face attachment of income. But there should always be a minimum amount left to live on. This is called the attachment-free amount. The algorithm (which consists of a set of calculation rules) helps calculate the debtor's attachment-free amount automatically as much as possible.
