Goal and impact
Municipalities report through IB which parents participate in a reintegration programme. This is passed on to the Benefits Agency. This makes it possible to determine whether - and when - parents are entitled to childcare benefits.
For parents, this means less administrative burden and a fairer assessment of their application. Municipalities can thus better help parents combine work, care and education.
Role of the Municipality:
- Municipalities register which parents follow a reintegration programme and pass this on to IB.
- Customer managers of the municipality tell parents that it can be important to apply for childcare benefits from the Benefits Agency.
In this way, IB, municipalities and the Benefits Agency together ensure that parents get the support they need. This is not only fair, but also socially valuable.
Considerations
IB is an information hub for municipalities in reintegration support. Municipalities are obliged to inform the Benefits Agency. This algorithm helps municipalities do this securely and always in the same way.
The processing takes place on an individual basis, only at the request of Benefits, and concerns data needed to determine whether parents are entitled to childcare benefits in the context of reintegration.
Human intervention
For the IB itself, this algorithm does not involve human intervention. The algorithm executes rules devised by humans and is not 'self-learning'.
However, the IB does ensure that the processing process has been done properly.
The municipality decides whether and how to deal with a change.

Legal basis
The processing of personal data through the 'Answer Service DGO-KOT' takes place on the basis of: a legal obligation (Article 6(1)(c), AVG): The parties involved process personal data because they are legally obliged to do so under the Childcare Act (Wko), the General Act on Income-related Schemes (Awir), the SUWI Act and the Participation Act.
Benefits Service:
Is data controller for the allocation, payment and recovery of childcare benefits pursuant to:
- Section 1.3(1), Childcare Act (Wko);
- Article 11, second paragraph, Awir.
- The Wko falls within the scope of the Awir (Article 1.3, second paragraph, Wko).
Municipalities:
- Are processing responsible for the registration of reintegration trajectories of Target Group parents and for providing these data to the Benefits Agency.
- Pursuant to Article 38(1) of the Awir, municipalities are obliged to provide data to Toeslagen insofar as they are relevant for the implementation of the Awir.
- The implementation of re-integration activities by municipalities takes place on the basis of the Participation Act, whereby municipalities have policy discretion to determine which activities qualify as a re-integration programme and therefore give entitlement to childcare benefits.
Intelligence Bureau Foundation (IB):
Processes data in the context of the DGO-KOT answering service on the basis of:
- Section 63 of the SUWI Act;
- Section 5.24 Decree SUWI;
- Section 67(2) Participation Act;
- Section 47(2) Income Support for Older and Partially Disabled Unemployed Workers Act (IOAW);
- Section 47(2), Income Support for Older and Partially Disabled Former Self-Employed Persons Act (IOAZ).
Under Section 5.24 of the SUWI Decree, IB and municipalities are jointly responsible for this data processing. The details of this joint responsibility are included in the SUWI Regulation and its appendices, including the description of the AVG responsibilities and division of tasks, whereby the actual task of providing data from the DKD to Toeslagen is assigned to IB.

Technical design
Explanation of message flows:
A: Toeslagen sends a Question Message DGOKOT to the IB whenever they want (variable). The request message is used to request the current reintegration route(s) within the consideration period specified by Benefits for one BSN. The Request Message DGOKOT contains the BSN, Date start of period of consideration (specified by Benefits), Date end of period of consideration (specified by Benefits).
B: The IB receives a Question Message DGOKOT from the Benefits, the DKD answering service locates where the DKD data reintegration can be retrieved. The IB consults the GSDD File Reintegration message from the DKD and uses it to compile the response message for Benefits.
C: The DGOKOT response message is returned to the Benefits.
